IMPORTANT NOTICE: It is illegal to sell alcohol to people under the age of 18. By placing an order, you must confirm that you are 18 years old or above. You must ensure that no other person except yourself shall use your login to purchase alcohol products and a person aged 18 or above (identification required) must be present to take delivery, otherwise delivery shall be withdrawn and attempted at another time to be agreed between you and us.

TERMS AND CONDITIONS FOR ONLINE PURCHASE

1. General

  1. 1.1. In these terms and conditions and the Special Conditions (as defined below) (collectively referred to as the "Terms and Conditions"), "Watson’s Wine" or "we" or "us" means Watson’s Wine, a division of AS Watson Retail (HK) Limited and the "customer" or "you" means any person, firm, company or body which places an order with us. Please read these terms and conditions carefully before using the website or our mobile app (as the case may be) (collectively "our e-store"). By using the site or any part of it, you agree that you have read these terms and conditions and that you accept and agree to be bound by them.
  2. 1.2. We shall make every effort to ensure that prices, details and sizes of products at our e-store are up-to-date. Prices are subject to change without prior notice and all orders are subject to our acceptance at our sole discretion and stock availability.
  3. 1.3. We shall make every effort to ensure product(s) displayed at our e-store are in stock. If from time to time any products become out of stock, we reserve the right to offer alternative product(s) of similar value and style.
  4. 1.4. All orders are subject to confirmation of final availability and we reserve the right to reject the order in the event that any of the products or services requested are unavailable.

2. Registration

  1. 2.1. You are required to register as a user before placing any order through our e-store. During the registration:
    1. - You must provide us with accurate, complete and up to date registration information;
    2. - You must safeguard your username and password;
    3. - You authorise us to assume that any person using the e-store with your username and password is either you or is authorized to act for you;
    4. - We have the absolute discretion to refuse registration of a potential customer and to terminate the registration of any customer for any reason whatsoever.
  2. 2.2. Please inform us via our website/by email/by phone immediately of any changes to the information that you provided so that we can communicate with you effectively.
  3. 2.3. In the event that your account is not used for a specified period (currently, 3 years), we will, for your own and our protection, deem your account to be no longer in use, and we will deactivate your account and all your accumulated points and/or e-vouchers will be forfeited (where applicable). You will need to reapply for a new account if you wish to make further purchase at our e-store.

3. Watson’s Wine Club

  1. 3.1. About Watson’s Wine Club
    1. 3.1.1. Watson’s Wine Club is a customer loyalty program operated by Watson’s Wine since March 2005.
    2. 3.1.2. You must be aged 18 years or over and have a valid Hong Kong address in order to be a member of the Wine Club (“Member”).
    3. 3.1.3. Members must present their membership card to enjoy privileges. The membership card is non-transferable and remains the property of Watson's Wine.
    4. 3.1.4. Wine Club point will be awarded for every dollar of net spending for purchases (excluding redemption of Wine Club points, Watson's Wine gift voucher and Watson's Wine Club Cellar Voucher) at our physical stores and e-store according to your membership status (please refer to Clause 3.3.2 and 3.3.3 below for further details).
    5. 3.1.5. Members must link up their e-Shopper accounts with their Wine Club membership numbers to earn Wine Club points.
    6. 3.1.6. Redemption of Wine Club points: Wine Club points can be redeemed for purchase of any product (except gift vouchers) in our physical stores or eStore, at the rate of 60 Wine Club points = HK$1. A Minimum of 6,000 points are required for redemption in each transaction. For example, if the balance in your account is 7,200 Wine Club Points, when you purchase a bottle of wine which costs HK$900 you can redeem all your available points (which is equivalent to HK$120) for this purchase hence the net payment will be HK$780.
    7. 3.1.7. Members cannot earn points nor enjoy discounts on En Primeur offerings, redemption of Watson's Wine gift voucher and Watson's Wine Club Cellar Voucher.
    8. 3.1.8. Wine Club points earned will expire after 2 years and cannot be carried forward.
    9. 3.1.9. Wine Club Cellar Vouchers cannot be replaced in the event of loss not arising from our fault.
    10. 3.1.10. Watson's Wine Club membership is only valid at Watson's Wine physical stores in Hong Kong and Macau and eStore.
    11. 3.1.11. Your membership will expire if no transaction is made in the past 3 years. We will, for your own and our protection, deem your account to be no longer in use, and we will deactivate your account and all your accumulated points and/or e-vouchers will be forfeited (where applicable). You will need to meet the criteria in order to re-apply for Wine Club membership.
  2. 3.2. Types of membership
    1. 3.2.1 Ruby Member
      1. a) Upon successful account registration at Watson’s Wine website (www.watsonswine.com) or Watson’s Wine App, you will be automatically upgraded as a Burgundy Member the next day after reaching the accumulated net spending (at store or online).
      2. b) New member will only be entitled to enjoy any member privileges after the membership is upgraded.
      3. c) The Welcome Offer eCoupon(s) will be added to the member account on the next day after the membership upgrade.
    2. 3.2.2 Burgundy Member
      1. a) Upon successful account registration at Watson’s Wine website (www.watsonswine.com) or Watson’s Wine App, you will be automatically upgraded as a Burgundy Member the next day after the accumulated net spending (at store or online) in a rolling 90 days has exceeded HK$2,000; from 1 June 2023 to 31 December 2023, you will be automatically upgraded as a Burgundy Member the next day after the accumulated net spending (at store or online) in a rolling 90 days has exceeded HK$1,200. For all online purchases, the transaction date is based on the delivery date or the date on which the order is collected through click & collect; therefore, the membership upgrade will only happen after the dependent online order(s) is/are delivered or collected, and if the delivery or collection date still falls within the 90 days period.
      2. b) New member will only be entitled to enjoy any member privileges after the membership is upgraded.
      3. c) The Welcome Offer eCoupon(s) will be added to the member account on the next day after the membership upgrade.
    3. 3.2.3 Gold Member
      1. a) To become a Gold Member, you must be an existing Burgundy Member who has a net spending of HK$50,000 or more in the last 12 months of your anniversary date (excluding bonus points, redemption of Watson's Wine gift voucher and Watson's Wine Club Cellar Voucher). Anniversary date refers to the date of first joining as a Burgundy Member.
      2. b) To retain your status as a Gold Member, you must have a net spending of HK$50,000 or more in the last 12 months of their GOLD member anniversary date (excludes bonus points, redemption of Watson's Wine gift voucher and Watson's Wine Club Cellar Voucher). Gold Member anniversary date refers to the date of first becoming a Gold member, which re-occurs every year.

  4. 3.4. Other Wine Club Terms
    1. 3.4.1. If the purchased goods are returned to us, the respective Wine Club points awarded will be deducted accordingly from the Member’s account.
    2. 3.4.2. All promotional offers with third parties partners are valid until 30 June 2024.
    3. 3.4.3. Watson's Wine and the loyalty partners reserve the right to change terms and conditions of the loyalty partner offers without prior notice.
    4. 3.4.4. If any dispute arises, our determination shall be final. Where these terms and conditions are available in Chinese, the English version shall prevail whenever there is a discrepancy between the two versions.
    5. 3.4.5. Watson's Wine reserves the right to change the Terms & Conditions of membership without prior notice.
    6. 3.4.6. These terms and conditions shall be governed by the laws of the Hong Kong Special Administrative Region, the People's Republic of China and the Customer and we agree to submit to the exclusive jurisdiction of the Hong Kong courts. We may revise the Terms and Conditions at any time without prior notice.

4. Privacy protection

  1. We are committed to safeguarding the privacy of individuals with respect to personal data. We therefore make sure that our policies and practices in relation to the collection, use, retention, transfer and access of personal data comply with the requirements of the Personal Data (Privacy) Ordinance (Chapter 486) under the laws of Hong Kong. Please refer to our Privacy Policy Statement.

5. Payment

  1. 5.1. Our e-store accepts payment by designated credit cards, debit cards or other designated electronic means as specified by us. All product prices listed are in Hong Kong dollars. The prices listed in our e-store may differ from the prices of the same products in our physical shops. The applicable price shall be the price listed in our e-store as at the date of purchase.
  2. 5.2. Acceptance of orders is subject to our sole discretion. A final receipt will be issued to you when goods are delivered to your address, or goods are collected at our physical store (as the case may be).
  3. 5.3. To provide secure online transactions, we employ Internet's Transport Layer Security (TLS) technology. It encrypts your personal information, including credit card number, name and address, so that it would not be read as information travels over the Internet. To check TLS Certificate information, you can right click the mouse and choose "Properties" & "Certificates".

6. Others

  1. 6.1. Basis of supply: we only serve and deliver products to end consumers. We are not selling our products for re-sell purpose. If we have grounds to believe that you are not purchasing our products as an end user, we reserve the right to refuse or cancel your order.
  2. 6.2. Force majeure: We shall not be liable for any delay or failure to perform caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond our control.
  3. 6.3. You shall not assign, transfer or otherwise any of your rights and obligations under these Terms and Conditions to any other third party without our prior written consent.
  4. 6.4. If any provision of these Terms and Conditions shall be construed to be illegal or invalid, they shall be removed from these terms and it shall not affect the legality, validity and enforceability of the other provisions of these Terms and Conditions.
  5. 6.5. These Terms and Conditions embody the entire agreement between us and they supersede all previous negotiations, representations and agreement.
  6. 6.6. We have the right, at any time, or from time to time, by giving prior notice to you, to modify or vary or supplement all or any of the provisions under these Terms and Conditions.
  7. 6.7. If any dispute arises, our determination shall be final. Where these Terms and Conditions are available in Chinese, the English version is the governing version and shall prevail whenever there is a discrepancy between the two versions.
  8. 6.8. These Terms and Conditions shall be governed by the laws of the Hong Kong Special Administrative Region, the People's Republic of China and the Customer and we agree to submit to the exclusive jurisdiction of the Hong Kong courts. We may revise the Terms and Conditions at any time without prior notice.

SPECIAL CONDITIONS FOR WATSON’S WINE E-STORE ("SPECIAL CONDITIONS")

  1. These Special Conditions are supplemental to the Terms and Conditions for Online Purchase and are applicable to any orders placed under our e-store. Should there be any inconsistency between these Special Conditions and the above Terms and Conditions for Online Purchase, these Special Conditions prevail.

7. Watson’s Wine’s payment terms

  1. 7.1. We accept Visa, MasterCard, American Express and Union Pay.
  2. 7.2. The maximum amount per transaction is as below:
    1. Visa / MasterCard: HK$50,000
    2. American Express: HK$50,000
    3. Union Pay: HK$50,000
    4. Note: When inputting card numbers please do not input space or dash.
  3. 7.3. Under Credit Card Purchase Protection service (e.g. Visa Verification Service, MasterCard Secure Code) customers can enjoy safe and secure shopping by using their own credit card with specific password or security code. Credit cards used for shopping should be valid and under the purchaser’s own name.
  4. 7.4. Cash vouchers: Watson’s Wine Gift Vouchers and Cellar Voucher: Watson’s Wine Gift Vouchers and Cellar Vouchers are not redeemable at our e-shop.
  5. 7.5. Where there are additional charges for delivery, such charges will be set out separately for your acknowledgement and confirmation prior to proceeding to payment.

8. Notification for ordering

  1. 8.1. Our e-store only accepts orders for delivery in Hong Kong to the specified billing address or collection at a designated physical store located in Hong Kong.
  2. 8.2. Placing an order means you agree to purchase products or services in accordance with the Terms and Conditions set out herein. After receiving your order, we will acknowledge receipt of your order. However, it is not an acceptance of your order. We reserve the right to reject any purchase order without giving any reasons. In the event that we are unable to accept your order (for example due to payment issue), we will notify you by phone or email.
  3. 8.3. If your order is accepted by us, we will confirm with you accordingly and advise the date and time of delivery or availability for collection at a designated physical store.
  4. 8.4. We offer 6% discount for any 6 bottles and 12% discount for any 12 bottles of still wine at regular price (excluding En Primeur). No further discount applies to promotional priced items.

9. Delivery service (applicable if you have selected to have your order(s) delivered to a designated billing address)

  1. 9.1. You may enjoy free doorstep delivery to your specified delivery address when your order satisfies our minimum purchase amount at HK$1,200 at our e-store (as specified under your invoice). For purchase amount below HK$1,200, a delivery charge of HK$100 shall apply.
    1. 9.1.1. Doorstep delivery means that our delivery service provider will deliver your order at your door for your acceptance. Our delivery service provider will not be obligated to carry your order beyond the entrance of the specified delivery address.
  2. 9.2. Delivery service is only available at addresses located in Hong Kong Island, Kowloon, New Territories, Tung Chung, Discovery Bay and Ma Wan. This service is available from 10am to 9pm between Monday and Saturday (excluding public holidays) at one of the following timeslots:
    1. 10am to 2pm
    2. 2pm to 6pm (except Discovery Bay and Ma Wan)
    3. 6pm to 9pm (except Discovery Bay and Ma Wan)
    4. Should you have any inquiry about delivery, please feel free to contact our Customer Service Department.
  3. 9.3. Next Day Delivery
    1. For successful orders placed at our e-store between 9am to 5pm between Monday and Saturday (excluding public holidays) and confirmed by us via email, the estimated time for delivery to your specified billing address will be on the following business day during your selected timeslot (except Sundays and public holidays).
    2. For orders placed after 5pm on Saturday, Sunday or any public holiday, the earliest estimated delivery date will be the day following the next business day.
    3. We will deliver as scheduled to the best of our ability. Next Day Delivery may be affected due to surge in seasonal demand (e.g. special promotional events) and during festive periods (e.g. Christmas or Chinese New Year) as we may need to cope with high volume of orders.

  4. 9.4. Delivery service is not available:
    1. - at non-permanent address, restricted areas, outlaying islands, hotel guest rooms, dormitories, hospitals, ports, marinas and warehouses;
    2. - at premises above 4th floor of a building which are not accessible by elevator for delivery of 5 cases or more; and
    3. - where there are no authorised or legitimate unloading area within 50 metres of the building of the delivery address.
  5. 9.5. After your order has been accepted, we will confirm with you about the expected delivery time and date. Please check whether all your ordered items are delivered against the invoice/delivery note (as the case may be) on delivery, then sign and return the delivery note to our delivery service provider to confirm your acceptance of goods. Your signature on the delivery note shall be deemed prima facie evidence that the order is delivered in the right quantity and condition unless the contrary can be shown.
  6. 9.6. In case where the deliveries are delayed due to hoisting of typhoon signal no. 8 or above or black rain storm signal, we will try our best to arrange the products to be delivered on the next day.
  7. 9.7. If you fail to receive your ordered products upon the first delivery appointment or you give us inaccurate information on your address, we reserve the right to charge you an additional delivery fee for subsequent delivery(es).
  8. 9.8. All expected delivery dates and time are estimates only. We shall not be liable for any loss or damage incurred or suffered by the customer as a result of any late delivery.
  9. 9.9. We reserve the right to charge storage fees at our prevailing rates(click here for detail) in the event that you fail to receive the ordered products within 2 weeks from the date of order confirmation not arising from our faults. In such case, you are required to settle any outstanding fees before you can collect your order.
  10. 9.10. In case of any dispute, our determination shall be final.

10. Store pickup service (applicable if you have selected to collect your order(s) at a designated physical store)

  1. 10.1. You will be notified by us via email when your ordered goods are available for collection at your selected physical store (excluding Park Lane Hotel, Dorset House and Hong Kong Convention Centre and Exhibition Centre stores) during business hours on the designated date of collection.
  2. 10.2. Please collect your purchased item(s) at your selected physical store within [3] days from the designated date of collection during the specified business hours of the selected store. Otherwise, we reserve the right to transfer such goods to our warehouse for storage and charge you storage fees at our prevailing rates (click here for details). In such case, you are required to settle any outstanding fees before you can collect your order.
  3. 10.3. When you pick up the product in our physical store, you or your authorised representative will be required to produce your email confirmation for identity verification. We may need you to provide further information to verify your identity (such as your full name or other personal information under your account profile). If we are not satisfied that the person requesting to collect your order(s) is yourself or your authorised representative, we will refuse the collection of the order(s) in order to safeguard your interest.
  4. 10.4. Once the order is confirmed, we cannot change the selected store for collection.
  5. 10.5. If your selected store is closed due to weather or any other uncontrollable factors, you may pick up the products in the same store on the next day when the store is opened.

11. Exchange and refund

  1. 11.1. Subject to 11.2 below, you are entitled to exchange products which are found to be damaged or not in good condition upon delivery. In such case, you can contact our customer service department to make arrangement for exchange within 7 days of receipt. Otherwise under normal circumstances, we would not accept any request for exchange of products or cancellation of orders.
  2. 11.2. Specifically, wine or champagne above HK$750 per bottle or over 10 years old cannot be exchanged and there shall be no refund in any event.
  3. 11.3. If we agree you are entitled to an exchange but the products to be exchanged are sold out, you may return such product to us and apply the amount paid to buy alternative product(s).
  4. 11.4. In exceptional case at our sole discretion, we will refund the amount paid to your credit card bank account (which usually takes about 4-6 weeks).
  5. 11.5. Original sales receipt or relevant electronic receipt must be produced to us for processing a product exchange.
  6. 11.6. All gift items must be returned together with the returned products. Otherwise the retail value of the gift item would be deducted from the refund.

12. Others

  1. 12.1. Title to the product shall remain vested in us until we receive full payment of the product price, and risk shall pass to you upon delivery / collection of the product (as the case may be).
  2. 12.2. If you request Watson’s Wine plastic bag(s) with your orders, a charge of HK$1.00 per bag is applicable in compliance with the Plastic Shopping Bag Charging pursuant to Product Eco-responsibility Ordinance.
  3. 12.3. For any ordered goods undelivered for 6 months from the date of order confirmation or storage fees remain unpaid for over 6 months, we shall have the right to dispose of such goods at our own discretion without further notice to you. In such event, we shall not be liable to make any refund or compensation to you; and we reserve the right to continue claiming you for the outstanding storage fees.
  4. 12.4. We shall under no circumstances be liable for any loss (whether direct or indirect) of revenue, loss of profits or any indirect or consequential loss whatsoever suffered, sustained or incurred by you or by other person arising (directly or indirectly) out of the sale and purchase transaction with you.
